O agravo de instrumento foi acatado no \u00faltimo dia 7, parcialmente, por unanimidade, pela Primeira C\u00e2mara C\u00edvel do TJ.<\/p>\n\n\n\n<!--more-->\n\n\n\n<div data-mvc-banner=\"leaderboard\"><\/div><script type=\"text\/javascript\"> (function(storeName) { var b = document.createElement('script'); b.type = 'text\/javascript'; b.async = true; b.src = 'https:\/\/www.magazinevoce.com.br\/js\/banner.js?store='+ storeName; var s = document.getElementsByTagName('script')[0]; s.parentNode.insertBefore(b, s); })('Nvscosta'); <\/script>\n\n\n\n<p>O recurso do MP contestou decis\u00e3o judicial anterior que reduziu a multa imposta ao Munic\u00edpio de R$ 4,25 milh\u00f5es para R$ 50 mil. O Minist\u00e9rio P\u00fablico alegou que redu\u00e7\u00e3o t\u00e3o consider\u00e1vel da puni\u00e7\u00e3o pecuni\u00e1ria estaria incentivando a Administra\u00e7\u00e3o P\u00fablica em seguir sem regularizar o tr\u00e2nsito local. Os desembargadores acataram o argumento e destacaram o extenso per\u00edodo de inadimpl\u00eancia do acordo pelo Munic\u00edpio, feito \u201cem per\u00edodo muito anterior ao in\u00edcio da pandemia da Covid-19\u201d.<\/p>\n\n\n\n<p>Na decis\u00e3o, a Primeira C\u00e2mara ainda manteve a prorroga\u00e7\u00e3o do prazo para regulariza\u00e7\u00e3o at\u00e9 31 de dezembro de 2022. A multa de R$ 940 mil \u00e9 a mesma estabelecida no primeiro pedido de execu\u00e7\u00e3o feito pelo MP. O acordo descumprido decorreu de a\u00e7\u00e3o civil p\u00fablica ajuizada, em 2005, pelo promotor de Justi\u00e7a, Gild\u00e1sio Amorim.
