Dr. Alexandre Brito, se pronunciou a respeito do travamento do Projeto que visa a venda de um terreno p\u00fablico situado no centro da cidade.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>De acordo com Alexandre, ao contr\u00e1rio do que circulou na imprensa, o Minist\u00e9rio P\u00fablico n\u00e3o notificou a C\u00e2mara sobre suspens\u00e3o do projeto. A interrup\u00e7\u00e3o ocorreu na pr\u00f3pria Casa, ap\u00f3s a CCJR apontar falha t\u00e9cnica no texto enviado pela Prefeitura.<br><br>O procurador ainda explicou ao Pol\u00edtica e Bastidores que o problema central do projeto que pretende autorizar o prefeito Eriksson a vender o terreno em frente \u00e0 Pra\u00e7a Get\u00falio Vargas est\u00e1 na natureza jur\u00eddica do im\u00f3vel: <strong><em>\u201cele \u00e9 um bem afetado ao uso comum do povo, ou seja, um logradouro p\u00fablico\u201d.<\/em><\/strong><br><br><strong>Pelo uso cotidiano \u2014<\/strong> circula\u00e7\u00e3o de ve\u00edculos, estacionamento, continuidade f\u00edsica das ruas \u2014 o terreno n\u00e3o se enquadra como bem dominical. E, conforme a legisla\u00e7\u00e3o, s\u00f3 bens dominicais podem ser alienados.<br><br>A solu\u00e7\u00e3o n\u00e3o \u00e9 complexa. Segundo Alexandre, a pr\u00f3pria Prefeitura pode enviar uma emenda ao projeto, incluindo um artigo espec\u00edfico de desafeta\u00e7\u00e3o do bem. Assim, ele passa da categoria de bem de uso comum para bem dominical.<br><br><\/p>\n\n\n\n<p><strong><u>Com isso regularizado:<\/u><\/strong><br><br>1. Primeiro, a desafeta\u00e7\u00e3o transforma o im\u00f3vel em dominical;<br>2. Depois, a C\u00e2mara pode analisar a autoriza\u00e7\u00e3o para alien\u00e1-lo.<br><br><strong>Onde a tramita\u00e7\u00e3o travou<\/strong>?<br><br>A C\u00e2mara n\u00e3o descumpriu a lei \u2014 apenas recebeu o projeto. O \u201cfreio\u201d ocorreu porque a CCJR identificou a inconsist\u00eancia e, para evitar v\u00edcios legislativos, suspendeu a tramita\u00e7\u00e3o at\u00e9 que o Executivo ajuste a t\u00e9cnica.<br><br>A medida \u00e9 procedimento normal e preventivo, garantindo que o processo n\u00e3o avance com lacunas jur\u00eddicas.<br><br><strong>Hist\u00f3rico que ajuda a entender o cuidado atual<br><\/strong><br>Alexandre lembrou epis\u00f3dio semelhante, ocorrido h\u00e1 cerca de 15 anos na gest\u00e3o de Z\u00e9 Grilo, quando se tentou doar um terreno com caracter\u00edsticas de pra\u00e7a. Na \u00e9poca, a Justi\u00e7a barrou a proposta justamente pelo mesmo motivo: era um bem afetado.<br><br>A lembran\u00e7a serve menos como cr\u00edtica e mais como alerta \u2014 o munic\u00edpio j\u00e1 passou por isso e sabe o caminho correto.<br><br>Com a emenda de desafeta\u00e7\u00e3o, o projeto volta a caminhar normalmente pelas comiss\u00f5es e pelo plen\u00e1rio.
